Beattie's battle with County could end next week

An Ontario Municipal Board (OMB) hearing is scheduled for next Monday (June 16) morning in Alliston under the Expropriations Act pitting Willies Car and Van Wash Ltd., against Simcoe County.

Willies, located at 583 Victoria E, and owned by Ron Beattie, launched a claim back in 2010 alleging combined financial losses of approximately $500,000 as a result of Simcoe County rerouting Cty Rd 10, and closing off Tottenham Road, "which had been the principal access point to the nearby Honda manufacturing facility from Hwy 89."

Specifically, Mr. Beattie, represented by solicitor Jay Feehely, claims rerouting the County road "led to a significant drop in the number of vehicles using its car wash leading to:
1. Income Loss for Fiscal Year ending February 28, 2009 - $170,000
2. Loss of market value - $300,000
3. Compensation for out of pocket expenses due to the claim - $20,000
4. Legal, accounting, appraisal and other costs 
5. Interest on compensation.

The County contends that traffic through the car wash "didn't fall off significantly until fiscal years 2008 and 2009" which "coincided with a severe recession in the auto industry and the subsequent elimination of the third shift at Honda."

According to minutes of previous OMB reports posted online, particularly the memorandum of oral decision posted this past January 21, Willies was ordered to provide full disclosure "to all questions" - believed to include financial information supporting the claims for revenue losses.

"Failure to comply with this direction of the Board will result in Notice of Arbitration and Statement of Claim of the Claimant being struck and the Board's file being closed."

At this post, it could not be confirmed whether those terms were met. Monday's hearing will begin at 10 am in the council chambers in Alliston.
