'The laws of other jurisdictions still apply' re aerodrome fillto the editor,
Posted September 3, 2014
I'm writing today to set the record straight and provide my constituents that reside in the town of New Tecumseth with the facts regarding the Tottenham-Volk Aerodrome.
I want to be clear to all the residents in New Tecumseth
- the regulation of fill for aerodromes is not under federal
Aerodrome operators need to identify and comply with all applicable legislation and regulations, whether that be municipal or provincial. This same issue was dealt with by the Ontario Court of Appeal earlier this summer, when they confirmed that municipal fill bylaws would continue to apply to an aerodrome in Burlington.
Transport Canada Ontario Region has been aware of this issue
for some time. Fill concerns were raised in Scugog in 2009, the
Tottenham-Volk Aerodrome in 2011, and at the Greenbank Aerodrome in
2012. Transport Canada's messaging has been consistent in all
these matters: Transport Canada does not regulate fill and cannot
provide legal advice on the jurisdiction of other authorities.
