'The laws of other jurisdictions still apply' re aerodrome fill

I'm writing today to set the record straight and provide my constituents that reside in the town of New Tecumseth with the facts regarding the Tottenham-Volk Aerodrome.

I want to be clear to all the residents in New Tecumseth - the regulation of fill for aerodromes is not under federal control.

I know that this is an extremely important issue that has adversely affected several of our local residents.

It is important you know the facts regarding this issue. Most importantly, the federal government's exclusive mandate extends only to matters integral to aeronautics, which does not include land fill. Therefore, the laws of other jurisdictions still apply.

Aerodrome operators need to identify and comply with all applicable legislation and regulations, whether that be municipal or provincial. This same issue was dealt with by the Ontario Court of Appeal earlier this summer, when they confirmed that municipal fill bylaws would continue to apply to an aerodrome in Burlington.

Transport Canada Ontario Region has been aware of this issue for some time.  Fill concerns were raised in Scugog in 2009, the Tottenham-Volk Aerodrome in 2011, and at the Greenbank Aerodrome in 2012. Transport Canada's messaging has been consistent in all these matters: Transport Canada does not regulate fill and cannot provide legal advice on the jurisdiction of other authorities.

Transport Canada's Civil Aviation Safety Inspector last visited Tottenham/Volk Aerodrome on Friday April 13, 2012 to review the activities taking place on the site at the request of myself and others due to the concerns raised by our residents. The inspector did not observe any contraventions or non-compliance with the Aeronautics Act or Canadian Aviation Regulations (CARs). The aerodrome owner's obligations under the CARs were reviewed and discussed.

Since 2012, Transport Canada has not received any complaints with regards to the Tottenham/Volk Aerodrome.

Let me reiterate once again regarding the fill concerns, this is not a federal issue but one to be managed by the Town of New Tecumseth and the Province of Ontario.
